Drafting environmental risk management policies - Three New England regional banks retained the firm to draft environmental risk management policies to help ensure compliance with FDIC guidelines. As part of bank-specific implementation of the policies, our attorneys undertook training sessions regarding environmental matters and risk management policy with risk management officers, bank managers, loan officers and account representatives.

Untangling hydropower assets - Our lawyers carefully crafted a strategy to allow our client to sell a large and valuable hydropower asset that was physically integrated with its existing pulp and paper mill asset. The transaction included a very complicated purchase and sale agreement involving intricate environmental risk allocation and risk management provisions between the buyer and seller to legally separate the hydro power asset from the mill asset, all of which had to be layered on top of existing environmental covenants that governed the property due to a prior transaction including the facility.

Groundwater contamination case resolved - Two decades of investigation, monitoring and remediation failed to resolve a case of groundwater contamination by our client, the former owner of an active major industrial facility. Our lawyers helped craft an innovative solution to compensate the State for the environmental impact and bring the lengthy process to a close through a natural resources damage settlement. After the value of the affected resource was determined, alternative natural resources of comparable value were identified. Through a first-of-its-kind set of agreements involving our client, the State, the current owner and a well-established environmental organization, the environmental group purchased the alternative resources for public use (funded by grants from our client) and the matter reached a global settlement.

The project involves complex consultation processes and permitting, efforts involving numerous federal and state agencies, including FERC, DOI, USCG, Army Corps, Maine DEP, Maine State Planning Office, as well as local governments.

Plum Creek - For Plum Creek, the nation's largest private landowner, our firm led a team that petitioned Maine's Land Use Regulation Commission (LURC) to rezone nearly 420,000 acres of land in Northern Maine. After proceedings lasting three and a half years, Plum Creek's petition to rezone was unanimously approved by LURC. The Concept Plan is the largest development plan in Maine history and the effort was by far the most complex and contentious regulatory proceeding in Maine history. The rezoning authorizes Plum Creek to develop approximately 16,000 acres for 975 house lots and land for two resorts on Moosehead Lake. The Plan sets aside conservation easements of 392,000 acres to be permanently preserved as sustainable forestry and establishes a significant affordable housing program.
