Maine WC Alert: WCB Orders Remote Hearings Unless In-Person Deemed Necessary

Maine Workers' Comp Alert

COVID-19 Concerns Prompt Maine WCB to Order That Hearings Be Conducted Remotely Unless It Is Deemed Necessary to Conduct a Hearing In-Person

On March 25, 2020, the Maine WCB issued an order regarding the conduct of remote proceedings. The WCB stated, “In response to concerns regarding COVID-19, the Board is working to strike an appropriate balance between conducting business and supporting social distancing.” Therefore, “effective immediately” the following policies are in place:

  • Troubleshooting: Will be conducted by phone.
  • Mediations: Will go forward as scheduled and will be conducted by phone.
  • Hearings: Will be conducted by phone or other form of remote technology. Currently, Court Call is an option and the WCB is looking into whether other methods (e.g., Zoom, Skype) can be used. If all parties believe an in-person hearing is necessary, parties must contact the Administrative Law Judge assigned to the case.
