Practice Areas : Litigation

Preti Flaherty’s Litigation Group is one of the largest and most respected litigation practices in northern New England. Recognizing that success is often the result of pre-trial counseling, we advocate for our clients wherever necessary – including consensual or mandatory ADR, domestic or international arbitration, and trials in state and federal court.

Our experience is varied and extensive, including noteworthy successes in matters such as class action litigation, toxic tort litigation, securities claims, anti trust matters, professional liability litigation, construction claims, lender liability claims, injunction of governmental agencies on constitutional grounds, and libel defense of national publications and broadcasters.

Licensed in over a dozen states and numerous federal courts, our litigation team consists of over 30 litigators, including four senior partners who each bring 30+ years of trial experience to the group.

Representative Matters:

  • Achieved record award in Maine of $40 million for Kingspan Group plc, a publicly traded Irish corporation, in claims for common law fraud and securities violations.
  • Won a $7.4 million jury verdict against Fleet National Bank for financial planning malpractice.
  • Secured a seven figure settlement for Aetna in a national claim arising from the recall of defective prosthetic products manufactured by Sulzer, Ltd.
  • Received national media attention for successfully defending Forbes magazine in a $10 million libel action.
  • Successfully defended Peoples Heritage Savings Bank in a major lender liability suit.
  • Litigated on behalf of Bath Iron Works (a Division of General Dynamics) to secure multi-million dollar recovery in construction claims involving its new land level transfer dry dock facility.
  • Defended Visa U.S.A., Inc. and Bayer Corporation in indirect-purchaser antitrust class actions.
  • Served as co-lead counsel in negotiating a remediation plan with the EPA in Maine’s largest “Superfund” action.

Preti Flaherty recognizes that when litigation becomes necessary, businesses face a critical choice in selecting legal counsel. In the art and science of litigation, there is no substitute for experience, which we consistently use to the advantage of our clients.
