Attorney Jeffrey D. Talbert Received Gold Medal For Exceptional Service From EPAJanuary 9, 2011
Preti Flaherty announced today that attorney Jeffrey D. Talbert, who practices as Of Counsel in the firm's Environmental Practice Group, has been awarded a Gold Medal for Exceptional Service by the United States Environmental Protection Agency (EPA). The gold medal, the agency's highest honor award, was awarded in recognition of his service at the Department of Justice (DOJ) on the Appalachian Mining Clean Water Compliance Team, whose work resulted in precedent setting settlements and has changed the nature of mining enforcement.
At DOJ, Jeff lead a team of DOJ and EPA attorneys and experts that investigated several of the nations largest coal mining operations to determine their compliance with the Clean Water Act. After a two-year investigation and a federal court action, Jeff negotiated an agreement that resulted in the implementation of clean water compliance measures at over 100 coal mining facilities across three states and payment of the largest federal Clean Water Act penalty for water permit violations. This settlement formed the basis for EPA's ongoing enforcement activities in the coal mining sector.
At Preti Flaherty, Jeff advises clients on environmental compliance issues and represents clients in environmental litigation matters. In particular, Jeff has helped clients create environmental due diligence programs and obtain permits for projects and operations that impact the environment. He has also represented companies and individuals in environmental litigation, including defending a company against a state–lead enforcement action seeking a several hundred million dollar remedy.
