New Bill Could Dramatically Change New Hampshire's Mechanics' Lien Law

The New Hampshire Senate is considering a bill that would provide mechanics' lien rights to design professionals and would extend the time allowed to file and perfect a lien.
The bill, if enacted, would add architects, landscape architects, engineers, and surveyors to the class of tradesmen who are currently able to file and perfect a mechanics' lien for nonpayment of work related to a construction project. This bill follows last year's change in Massachusetts' law affecting design professionals' mechanics' lien rights. The bill would also extend the period of time within which a lien may be filed from 120 days to 180 days after work is completed. The text of the proposed legislation can be found at SB 371. If passed, the legislation would become effective on January 1, 2013.
