County Loses Lawsuit, Must Pay $75,000

Portland, ME - August 14, 2009 - Preti Flaherty Attorney Sigmund D. Schutz was quoted in the Ellsworth American article, "County Loses Lawsuit, Must Pay $75,000" by James Straub. Schutz represented MacImage, a Cumberland-based provider of software systems to registries of deeds, in this breach of contract civil suit against Hancock County.
As published in the Ellsworth American article, MacImage agreed in 2001 to create a digital, re-indexed compilation of the 1972-1976 deed indices at the county registry at no charge, on the condition that should the county ever hire another company to do similar indexing, then MacImage would be paid for indexing the 1972-1976 indices. The County argued that it had fulfilled its obligation by hiring MacImage to digitize the 1971-1936 indices and did not agree to pay MacImage if it hired another contractor to index earlier dates.
The nine-member jury returned a 7-2 verdict in favor of MacImage. The Court entered a judgment $75,000 judgment against Hancock County.
