Nancy W. McBrady joined Preti Flaherty's Portland office in 2007 and practices with the firm's Environmental Practice Group. Prior to joining the firm, Nancy served as an intern with the U.S. Attorney's Office, State of Maine, Appellate Division. She was also a 2006 summer associate with Preti Flaherty and a law clerk to Judge John Beliveau in Lewiston District Court. Before launching her legal career, Nancy was a management consultant with A.T. Kearney, Inc. in Chicago and New York and worked on projects ranging from strategic sourcing to change management initiatives.

Nancy earned her Juris Doctor, cum laude, from the University of Maine School of Law, where she was Executive Editor of the Maine Law Review. She earned her B.A. in political science from Williams College in 2000.

Nancy is a native of Lewiston, Maine and resides in Cumberland with her husband, James.

Representative Matters

Nancy has worked extensively on complex litigation and substantial permitting efforts since beginning at Preti Flaherty:

  • Lead associate on the legal team advising Calais LNG, a project that proposes bringing a liquefied natural gas (LNG) regassification terminal and accompanying send-out pipeline to Downeast Maine. Nancy has helped manage the complex permitting efforts involving numerous federal and state agencies, as well as local governments, managing numerous consultants and experts preparing large-scale applications required under the Site Location of Development Act, the Natural Resources Protection Act, the Clean Air Act, the Clean Water Act and the Coastal Zone Management Act.
  • Associate on legal team that defended against a $250 million unilateral cleanup order issued by the Maine Department of Environmental Protection. The administrative appeal of this order, the longest and most complex environmental administrative hearing ever conducted in the State, involved 1,813 exhibits and 26 expert witnesses presenting on highly technical engineering and scientific issues.
  • Handled environmental due diligence and permit transfers on behalf of sellers in the purchase and sale of companies with potential federal and state environmental liabilities.
  • Assisted in Superfund settlement negotiations.
  • Assisted clients with Clean Air Act, Clean Water Act, CERCLA and RCRA obligations.
