Professional Tennis Player Robert Kendrick Plans Immediate Appeal of ITF Sanction

08.01.2011

Orlando, FL (August 1, 2011) – Preti Flaherty, a law firm headquartered in Portland, Maine, and Hodgson Russ, a law firm headquartered in Buffalo, New York, announced today that professional tennis player Robert Kendrick plans to immediately appeal a 12-month sanction issued against him by the International Tennis Federation.

Brent Nowicki, who represented Mr. Kendrick with co-counsel Paul Greene, said, "Justice has not been served by the ITF's decision.  Mr. Kendrick unknowingly ingested a banned substance known as methylhexanamine.  Kendrick took a Zija XM3 capsule to assist with jetlag, without knowing that it contained a banned substance.  The product claimed to be ‘approved by the World Anti-Doping Association.'"

Paul Greene, a sports law attorney with Preti Flaherty, added "This decision will be immediately appealed to the Court of Arbitration for Sport.  This is not a case where Mr. Kendrick ingested the supplement to enhance his athletic performance.  The ITF's decision is not supported by the facts of Mr. Kendrick's case whatsoever."

Former and current tennis professionals such as John McEnroe, Tom Gullikson, John Isner, Robert Ginepri, James Blake, Amer Delic, Bobby Reynolds, and Michael Russell, have rallied behind Mr. Kendrick's case and want to see him compete in his final U.S. Open.  Both Mr. Nowicki and Mr. Greene are hopeful that the Court of Arbitration for Sport will hear and decide Mr. Kendrick's appeal in time for Mr. Kendrick to make an inspired run in the U.S. Open in front of his family, friends, fans, and new daughter.
