The Preti Flaherty Energy Practice has collectively over 150 years of practice in the law and regulation of energy resources, public utilities, wholesale power market design, retail deregulation, renewable energy development, energy conservation and demand response.

Operation of Wholesale Power Markets

Preti Flaherty has represented clients in each of the "organized" wholesale power markets in the United States. This work involves rule making before the Federal Energy Regulatory Commission (FERC) and implementation of FERC rules at the RTO and market levels. Our Group participated in establishing the mechanics of the markets including ISO New England, PJM, Southeast Power Pool and MISO.

Attorneys Anthony Buxton and Donald Sipe serve as members of the New England Power Pool (NEPOOL) Participants Committee. Sipe also served as Vice Chair of NEPOOL for several terms.

Development and Acquisition of Energy Projects

Preti attorneys specialize in turning undervalued existing resources into energy assets. For example, we have identified power generation opportunities for large manufacturers including renewables, waste or natural gas projects. We have assisted clients in the development of thousands of megawatts of electric generation projects such as:

• biomass plants (20 MW to 50 MW)
• multi-fuel (coal, TDF & biomass up to 100 MW)
• gas (up to 650 MW)
• hydro (.5 MW to 40 MW)
• solar installations of 2 to 80 MW each
• wind (4.5 MW to 250 MW)

The Preti team has also secured permits for these projects at the federal, state and local levels. Once projects are built and operating, Preti's Energy and Environmental attorneys have provided clients advice and counsel on all aspects of project operations, contract enforcement and compliance with market, reliability and environmental rules.

Retail Energy Markets

Procurement of energy resources and services at the retail level is increasingly complex but provides opportunities for savings and profits. Preti attorneys have enabled electric consumers to undertake appropriately compensated demand response and remunerative on-site renewable and distributed generation.
