DOL Issues New FMLA Regulations

On November 17, 2008, the DOL published long awaited changes to the FMLA regulations. These final regulations implement the requirements, imposed under the National Defense Authorization Act, to expand FMLA protections to family members of individuals who serve in the armed forces. They also clarify and make technical changes to the rules that guide employers' administration of FMLA leave. These changes become effective January 16, 2009. How Can Employers Prepare for these Changes?

  • Visit www.preti.com to access summaries addressing the major (but not all) changes implemented by the final FMLA rules.
  • Obtain and provide training to help you understand the changes implemented in the new rules.
  • Review and (as necessary) revise and update policies, procedures, notices and forms to ensure compliance before the effective date.
  • Remember to consider and address provisions of Maine's Family Medical Leave and Military Family leave laws when revising and updating policies, forms and practices.
